Terms and Conditions – Summer Campaign (2024)

 

1. Organizer

The organizer of the Summer Campaign (2024) (“Promotion”) is EKWB d. o. o., whose registered business address is at Pod lipami 18, 1218 Komenda, Slovenia, registration No. 3358151000 (“EKWB”).

2. Purpose of the Promotion

The purpose of the Promotion is the promotion of EKWB and its products through promotional offers featuring various discount codes (“Discount Codes”) with discounts on the regular purchase price of selected products (“Promotional Offers”). Total of seven (7) different Discount Codes shall be published and available during different periods of the Promotion Duration (as defined below).

3. Promotion Duration

The Promotion is available and valid only during the period starting with 9 August 2024 at 00:00 AM (CET) and ending on 6 September 2024 at 23:59 AM (CET) (“Promotion Duration”). However, each Discount Code and thus Promotional Offer shall be valid for seven (7) days following the date of the first publication of the Discount Code (“Promotional Offer Duration”) as per below:

Purchases after the end of the Promotional Offer Duration will not be eligible for Promotional Offers.

Promotional Offers are in any case available only while the stock of individual products, which are subject to that Promotional Offer, lasts.

4. Participation in the Promotion

 

The Promotion is available to end-customers deemed as consumers (natural persons) (“Customers”) in case of purchase in EKWB’s webshop available at https://www.ekwb.com/shop/. Individual Customers must be aged 16 years or more at the date of entry into the Promotion.

The Promotion is available worldwide.

For participation in the Promotion and individual Promotional Offer(s), the Customer must place a binding order during the Promotional Offer Duration via EKWB’s webshop for a product or products that are subject to that Promotional Offer (“Eligible Items”) and enter the Discount Code applicable to the Eligible Items at the end of the order process at the designated place within the purchase order form. After the Discount Code is used and accepted, the discount, applicable to the Discount Code, shall apply to the regular purchase price of the Eligible Items.

The Customer is not eligible for individual Promotional Offer and EKWB is not bound to provide the Promotional Offer purchase conditions in the following cases:

• For the purchase of ineligible items.
• The purchase is made outside of Promotional Offer Duration.
• The purchase is not made via EKWB’s webshop.

Promotional Offer cannot be applied to orders of Eligible Items that have already been finalized in the EKWB’s webshop by the Customer or for any previous purchases of Eligible Item(s), nor can it be used in conjunction with any other offer or discount.

Each Discount Code is valid for a one-time purchase only, while only one Discount Code per order can be used. The same Customer is entitled to use all of the Discount Codes pertaining to the Promotion, however only if placing separate purchase orders.

When placing an order which includes also items ineligible for that Promotional Offer and the Discount Code, the discount will apply exclusively to Eligible Items. The number of Eligible Items that may be ordered during the Promotional Offer Duration and/or Promotion is not limited. However, the Promotional Offers apply only to orders of household quantities, irrespective whether the order is made as a single order or as a combination of two or more orders. Orders exceeding household quantities will be disqualified at full and sole discretion of EKWB and no Promotion advantage will be awarded.

Applications of ineligible participants or applications not complying with these Terms and Conditions (“Ineligible Applications”) will be disqualified at full discretion of EKWB and no Promotion advantage will be awarded to such applicants.

None of the Promotional Offers can be combined with any other promotional offer valid at the time of order placement. The Promotion does not include preorder items and items pertaining to the Fluid Gaming line.

EKWB shall not be liable in case the participation in any of the Promotional Offers is not possible due to temporary unavailability of the website or for other technical reasons outside of EKWB’s control.

5. Promotional Offers

 

The content of each of the Promotional Offers is provision of a Discount Code, whereby a new Discount Code shall be published and provided for each of the seven (7) Promotional Offers. Each Discount Code shall be published on the EKWB’s webshop and its social media accounts on the Promotional Offer Duration starting date, as indicated under section 3. Promotion Duration and shall be available for use during the Promotional Offer Duration. Each Discount Code shall (i) include a different discount rate (ranging between 10 % and 18 %, allocated randomly among Discount Codes) and (ii) refer to different selected products and/or product groups (as indicated next to the Discount Code), although certain products and/or products groups may appear as eligible for discounts under different Discount Codes, i. e., within different Promotional Offers. The products and/or products groups subject to each Promotional Offer and each of the Discount Codes are flagged in the EKWB’s webshop. In each case the Discount Code shall apply to the regular purchase price of the Eligible Item, i. e., the purchase price of such product without any applied discounts or other promotions.

 

6. Conditions of the Promotion

 

The Promotion and the Promotional Offer are subject to these Terms and Conditions. These Terms and Conditions supplement and precede the Terms of Sale, available at our website www.ekwb.com. In case of conflicts between these Terms and Conditions and the Terms of Sale, these Terms and Conditions shall prevail.

Participation in the Promotion and each Promotional Offer is subject to acceptance of these Terms and Conditions and the Terms of Sale. By placing an order for products subject to the Promotion and Promotional Offer, the Customer indicates their agreement to be bound by these Terms and Conditions and the Terms of Sale.

EKWB reserves the right to change, amend, or withdraw these Terms and Conditions at any time. EKWB reserves the right to change, amend or cancel the Promotional Offer at any time.

The fulfilment of any order placed under any of the Promotional Offers’ conditions, or fulfilment of the Promotion promise, is subject to availability of the Eligible Items. EKWB does not guarantee availability of any products subject to Promotional Offers to individual Customers. EKWB reserves the right to cancel any order already placed in case of unavailability of the chosen Eligible Item or in case of Force Majeure. In case of placement of an order for any Eligible Item that is unavailable, EKWB will reject the order and notify the Customer thereof.

EKWB shall not be liable for accuracy or completeness of the description of any product subject to any of the Promotional Offers. The Promotional Offers products are as stated, the terms of the Promotion do not apply to any other products.

EKWB reserves the right to limit the availability of selected products before the lapse of the Promotion Duration, or change or modify the list of products subject to Promotion and/or individual Promotional Offers during the Promotion Duration and/or individual Promotional Offer Durations, or change the Promotion Duration and/or individual Promotional Offer Durations in case of unavailability of products subject to Promotion and/or individual Promotional Offers or Force Majeure.

“Force Majeure” for the purpose of these Terms and Conditions shall mean any unforeseeable event occurring after the public announcement of this Promotion that could not be expected, prevented or avoided and causes a delay in performance or the inability of EKWB to fulfil it. Examples of Force Majeure shall include e. g. natural disasters and catastrophes such as epidemics, nuclear accidents, fire, floods, hurricanes, earthquakes; actions or omissions of civil or military authorities, declaration of state of emergency, war or mobilisation, civil war or uprising, riots, sabotages or revolutions, etc. Any changes to the Promotion will be notified to participants as soon as possible.

The benefits of the Promotion cannot be converted to any other benefits, used with any other purchases, redeemed in cash or other alternatives. The benefits of the Promotion are not transferrable or assignable to other consumers. The benefits of the Promotion may not be resold.

EKWB shall not be liable for inaccurate Promotional Offer details supplied to any participant by any third party connected with this Promotion.

EKWB assumes no responsibility or liability for any undesirable consequences that participants and/or anyone else could experience as a consequence of participation in this Promotion.

7. Withdrawal and returns

 

In the event that the Consumer wishes to exercise their right to withdraw from the contract (”cooling-off”) or exercises 30-Day Money Back Guarantee offered by EKWB, the conditions of the Terms of Sale apply. All refunds will match the discounted amount on the purchase receipt.

 

8. Warranty

 

Warranty conditions of the EKWB’s Terms of Sale apply, available at our website www.ekwb.com.

 

9. Applicable Law and Jurisdiction

The Promotion and these Terms and Conditions shall be, insofar permitted by mandatory law, governed by the law of the Republic of Slovenia, without regard to the conflict of laws provisions. Any disputes will be, insofar permitted by mandatory law, subject to the exclusive jurisdiction of the competent court in Ljubljana, Slovenia.
