EK Holiday Giveaway 2021
- Organizer
The organizer of the EK Holiday Giveaway 2021 promotion (»Sweepstakes«) is EKWB, d. o. o., whose registered business address is at Pod lipami 18, 1218 Komenda, Slovenia (“EKWB”).
- Purpose of the Sweepstakes
The purpose of the Sweepstakes is the promotion of EKWB and its products by awarding the winners selected products (“Sweepstakes Prize”).
- Sweepstakes Duration
The participation in the Sweepstakes is possible only during the period starting on 15 December 2021 at 10:00 AM (UTC+1) and ending on 5 January 2022 at 11.59 PM (UTC+1) (»Sweepstakes Duration«).
Entries before or after Sweepstakes Duration will not be eligible for the Sweepstakes Prize.
- Participation in the Sweepstakes
The Sweepstakes is only available to individual consumers (natural persons) aged 18 years or more at the date of entry. Sweepstakes is available worldwide, except where prohibited by law. Notwithstanding the foregoing, the Sweepstakes is not available to employees and associates of EKWB or its affiliated companies, their immediate family members or members of the same household, or anyone otherwise connected or affiliated to EKWB.
To participate in the Sweepstakes, the participant must:
- Submit all required information via the form available at https://www.com/celebrate-with-EK during the Sweepstakes Duration, including the indicated personal data collected for the purpose of the Sweepstakes in accordance with EKWB’s Privacy Policy, available at www.ekwb.com.
- Like or follow at least one of EKWB’s social media platforms (like EK Water Blocks on Facebook, or follow EKWater Blocks on Instagram or Twitter).
By submitting the application, the participant grants EKWB the permission to use the submitted information for the purpose of advertising, direct marketing and conducting market surveys, without the right to compensation, as well as profiling and automated decision making, particularly to use the data for creation of Facebook’s Custom Audience from the list of registered users.
Incomplete applications, applications of ineligible participants or applications not complying with these Terms and Conditions (“Ineligible Applications”) will be disqualified at full discretion of EKWB and no Promotion advantage will be awarded to such applicants.
No purchase is necessary to enter or win the Sweepstakes. A purchase does not increase the chances of winning.
Only one Sweepstakes application is permitted per person. Multiple applications from the same person will be disqualified. EKWB shall not be liable in case of temporary unavailability of the Sweepstakes application website or failure to receive an application. No participant can win more than one prize. The prizes are not transferrable or assignable to other persons. The Sweepstakes Prize cannot be combined with any other promotional offer.
EKWB shall not be liable in case the participation in the Promotional Offer is not possible due to temporary unavailability of the website or for other technical reasons outside of EKWB’s control.

- Winner Selection,Notification, Delivery
The winners will be selected by an automated random draw under the supervision of EKWB from among the received eligible applications. The odds of winning depend on the number of eligible entries received.
The winners will be selected within seven days from the end of the Sweepstakes Duration and notified via electronic mail within further seven days after the selection. The participants must ensure at their own cost and responsibility the possibility of delivery of the notice on winning the Sweepstakes Prize. EKWB shall not be liable for winner’s inability to receive the notice due to submission of incorrect contact data or security settings in the information system preventing the delivery of the notice.
The winner must claim the Sweepstakes Prize within seven days after reception of the notice and at request of EKWB provide completed and executed declaration and release statement.
EKWB will notify the winners of the anticipated delivery time, but assumes no responsibility or liability for possible delays that are not under EKWB’s control.
The Sweepstakes Prizes will be delivered to the winners, and only to the winners, at EKWB’s costs, to the address submitted at the time of Sweepstakes entry. All mandatory federal, state, and/or local taxes, duties, fees and charges associated with the reception of the Sweepstakes Prize in the country of the winner’s residence, shall be borne by the winner.
If the winner is not eligible for participation in the Sweepstakes (Ineligible Applications), cannot be contacted, fails to claim the Sweepstakes Prize within the set period, fails to timely provide the completed and executed declaration and release statement, or if the delivery of the Sweepstakes Prize is not possible due to reasons attributable to the winner (e. g. submission of wrong address), EKWB reserves the right to forfeiture of the Sweepstakes Prize with regard to the winner and selection of an alternate winner according to the procedure set forth above.
The winner shall ensure that the acceptance of the Sweepstakes Prize does not constitute a breach of mandatory law. In such case, EKWB reserves the right, at his sole and full discretion, to disqualify the winner and all privileges of the winner will be immediately terminated.
EKWB reserves the right not to award the Sweepstakes Prize if there is doubt about the identity of the participant, the accuracy of the data submitted by the participant or compliance with these Terms and Conditions.
- Conditions of the Sweepstakes
The Sweepstakes and the Sweepstakes Prize are subject to these Terms and Conditions. These Terms and Conditions (“Terms and Conditions”) supplement EKWB’s Privacy Policy, available at EKWB’s website www.ekwb.com. In case of conflicts between these Terms and Conditions and the Privacy Policy, these Terms and Conditions shall prevail.
The participation in the Sweepstakes is subject to Acceptance of these Terms and Conditions and the Privacy Policy. By submitting his/her application and participating in this Sweepstakes, the participant is indicating his/her agreement to be bound by these Terms and Conditions and the Privacy Policy.
EKWB reserves the right to change, amend, or withdraw these Terms and Conditions at any time. EKWB reserves the right to change, amend or cancel the Sweepstakes Prize at any time.
The Sweepstakes Prizes are as stated. The Sweepstakes Prizes cannot be converted to any other benefits, substituted with other products, redeemed in cash or other alternatives, unless EKWB decides otherwise at his sole and full discretion. The specifications of the Sweepstakes Prizes shall be within the full and sole discretion of EKWB. Prizes are subject to availability. In case the Sweepstakes Prizes are not on stock yet at the time the Sweepstakes is published, EKWB does not guarantee the availability of the Sweepstakes Prizes, e. g. due to logistics delays. EKWB reserves the right to substitute any prize with another of equivalent value without notice.
EKWB shall not be liable for accuracy or completeness of the description of any Sweepstakes Prize. EKWB shall not be liable for inaccurate Sweepstakes Prize details supplied to any participant by any third party connected with this Sweepstakes.
EKWB assumes no responsibility or liability for any undesirable consequences that participants and/or anyone else could experience as a consequence of participation in this Sweepstakes.
EKWB reserves the right not to award the prize, to cancel or amend the Sweepstakes without notice in the event of a Force Majeure event. “Force Majeure” shall mean any unforeseeable event occurring after the public announcement of this Sweepstakes that could not be expected, prevented or avoided and causes a delay in performance or the inability of EKWB to fulfil it. Examples of Force Majeure shall include e. g. natural disasters and catastrophes such as epidemics, nuclear accidents, fire, floods, hurricanes, earthquakes; actions or omissions of civil or military authorities, declaration of the state of emergency, war or mobilisation, civil war or uprising, riots, sabotages or revolutions, etc. Any changes to the Sweepstakes will be notified to participants as soon as possible.
EKWB’s decisions on winners as well as other matters pertaining to the Sweepstakes are final and binding. No challenges, complaints or other legal remedies shall be available.
- Warranty
For Sweepstakes Prizes, warranty conditions of the EKWB’s Terms of Sale apply, available at our website www.ekwb.com.
- Applicable Law and Jurisdiction
The Sweepstakes and these Terms and Conditions shall be governed by the law of the Republic of Slovenia, without regard to the conflict of laws provisions. Any disputes will be subject to the exclusive jurisdiction of the competent court in Ljubljana, Slovenia.
