PERSONAL DATA PROCESSING CONSENT AND COPYRIGHT LICENSE GRANT

By clicking “Agree”, you give your permission under the laws of the Republic of Slovenia to:

EKWB, d. o. o., Poslovna cona Žeje pri Komendi, Pod lipami 18, 1218 Komenda, Slovenia, registration No. 3358151000, VAT ID No. SI 30449383 (hereinafter: “EKWB”),

for the use of your following copyrighted works:

• testimonial statement,
• photographic material,
• audio and/or video material,

 

all pertaining to custom built water-cooled personal computers featuring EKWB’s products as submitted to EKWB, for the following purposes:

• Use for the purpose of informing the general public, advertising, promotion, marketing or other commercial purpose related to EKWB or its products (hereinafter: “Purpose”).

 

under the following conditions:

• The license is irrevocable, perpetual, territorially unlimited.
• The license is non-exclusive.
• The license is further transferrable and sub-licensable.
• The license extends to existing and future social, web-based or classic printed media and communication channels.
• My copyrighted works may be used in connection with or combined with other copyrighted works of any kind (text, photographs, graphics, video, sound, audio-visual works, etc.), whether created by EKWB or third parties, in entirety or in part, in original or modified form.
• The license shall be royalty-free, i. e. you shall not be entitled to any royalties, compensation or reimbursements in return for granting the license, and you waive any rights to claim any royalties, compensation, reimbursements or damages related to the grant of license.
• The license shall include all material copy-, performer- and related rights, specifically the right to reproduce the copyrighted works in any format, publicly perform the copyrighted works, publicly transmit the copyrighted works, publicly communicate the copyrighted works by phonograms or videograms, publicly present the copyrighted works, broadcast, re-broadcast and secondarily broadcast the copyrighted works, make the copyrighted works available to the public, modify the copyrighted works or prepare derivative works therefrom, distribute the copyrighted works, modified copyrighted works or works derived from the copyrighted works, rent the copyrighted works, modified copyrighted works or works derived from the copyrighted works, and advertise the copyrighted works, modified copyrighted works or works derived from the copyrighted works, record/fix your live performance, reproduce phonograms or videograms containing your live performance, publicly transmit your live performance, broadcast your live performance, make available to the public, distribute and rent phonograms or videograms containing your live performance.

 

You state and represent that you have the full right, power, and authority to grant this license. You acknowledge that in the event of a breach or alleged breach with respect to the terms and provisions hereof, EKWB shall be entitled to injunctive or equitable relief as EKWB may deem appropriate, in addition to other rights or remedies available at law.

You agree to indemnify and hold harmless EKWB from and against all claims, losses, expenses, and liabilities of every kind including reasonable attorney’s fees arising out of the inaccuracy or breach of any provision of this personal data processing consent and copyright license grant. You expressly release EKWB from any and all claims arising out of the use of the copyrighted material.

By clicking “Agree”, you give your permission under the laws of the Republic of Slovenia to:

EKWB, d. o. o., Poslovna cona Žeje pri Komendi, Pod lipami 18, 1218 Komenda, Slovenia, registration No. 3358151000, VAT ID No. SI 30449383 (hereinafter: “EKWB”),

to process your following personal data:

• Given name
• Voice, appearance, likeness, image, words, participation (if included in the submitted copyrighted material)

 

in connection with the Purpose as defined above.

 

By clicking “Agree”, you confirm that:

• The consent is given freely and without coercion, force or deception.
• You acknowledge that the personal data may be transferred cross-border to the countries outside of the European Union.
• Personal data may be entrusted to third parties for processing, including custodians, sub-custodians, internal or external auditors, or subcontractors, subject to adherence to GDPR-compliant measures and requirements.
• You acknowledge that personal data will be stored as long as needed for the Purpose, and not more than one year The personal data will also be deleted if no copyrighted materials are used for the Purpose within two years after submission or if so requested by you. After the expiration of the aforementioned period(s), personal data will be destroyed or anonymised.

 

In relation to your personal data we process, you have the right:

• To withdraw your consent to processing of your personal data at any time. Your withdrawal of consent will not affect the processing of your personal data prior to the consent withdrawal.
• To access: to request confirmation whether we process your personal data relating to you, and if so, to request a copy of that personal data, to ask about purposes of processing, categories of personal data concerned, whether personal data is transferred to a third country or international organization etc.;
• To rectification: to request that we rectify or update any personal data that is inaccurate, incomplete or outdated;
• To erasure (Right to be forgotten): to request that we erase your personal data in certain circumstances, such as when the processing of personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed or where we collected personal data on the basis of your consent and you withdraw your consent etc.;
• Of restriction of processing: to request that we restrict the use of your personal data in certain circumstances, such as when accuracy of the personal data is contested by you;
• To data portability: to request that we provide a copy of your personal data to you in structured, commonly used and machine-readable format in certain circumstances and you have the right to transmit that personal data to another controller in certain circumstances;
• To object at any time to processing of personal data for the Purpose;
• To appeal, independent of the above stated rights, to a supervisory authority if you believe that processing of your personal data violates the data protection regulations. We will promptly ensure that the request is complied with immediately, but no later than within one (1) month. You will receive requested personal data in a structured, machine-readable and generally applicable way. First copy of your personal data in electronic or hard is free of charge, each additional copy may be charged with a fee to cover the cost of preparing the copy.
