1. Organizer

The organizer of the “Refresh your build” (2023) (»Promotion«) is EKWB, d. o. o., whose registered business address is at Poslovna cona Zeje pri Komendi, Pod lipami 18, 1218 Komenda, Slovenia (“EKWB”).

 

2. Purpose of the Promotion

The purpose of the Promotion is the promotion of EKWB and its products through promotional offers featuring free gifts (“Promotional Offer”).

 

3. Promotion Duration

The Promotion is available and valid only during the period starting with 22 June 2023 at 09:00 AM (CET), and ending on 6 July 2023 at 09:00 AM (CET) (“Promotion Duration”).

Purchases after the end of the Promotion Duration will not be eligible for Promotional Offer.

Promotional Offer is only available while the stock of individual products subject to Promotional Offer lasts.

 

4. Participation in the Promotion

The Promotion is available to any end customer in case of purchase in EKWB’s webshop accessible at https://www.ekwb.com/shop/. Individual consumers (natural persons) must be aged 18 years or more at the date of entry into the Promotion.

The Promotion is available worldwide.

To participate in the Promotion, the customer must undertake all of the following steps during the Promotion Duration:

1. Place an order via EKWB’s webshop exceeding 250,00 EUR/USD/AUD (depending on the currency displayed in the webshop based on customer’s location) net (without VAT). The net amount includes possible discounts (i. e. the discounted price is relevant, not the original) and excludes shipping costs (if any are charged separately to the quoted product price).
2. When items whose aggregate price exceeds the threshold above are added to the shopping cart, a window will be displayed during the Promotion Duration notifying the customer of the eligibility for a free Promotional Gift. The customer must click on the button “Choose Your Coolant ” to be redirected to the web page where the Promotional Gift can be selected.
3. On the Promotional Gift Selection web page, the customer must select the desired Promotional Gift by clicking the button “Add to Cart” next to it. Upon selection, the selected Promotional Gift will be automatically added to the shopping cart free of charge and the customer will be returned to the webshop. If the customer removes items from the shopping cart so that the aggregate price of the items in the shopping cart drops below 250 EUR/USD/AUD, the Promotional Gift will be automatically deleted from the shopping cart.

The customer is not eligible for Promotional Gift and EKWB is not bound to provide the Promotional Gift in the following cases:

• The Promotional Offer threshold order value for free gift is not reached.
• The purchase is made outside of Promotional Duration.
• The purchase is not made in the EKWB’s webshop

The Promotional Offer is limited to one Promotional Gift per order, irrespective of the order value, as long as the order value remains above the Promotional Offer threshold (250 EUR/USD/AUD).

Promotional Offer cannot be used after a purchase order has been placed in the EKWB’s webshop or in conjunction with previous purchases.

The number of orders in connection with which the Promotion can be taken advantage of is not limited.

Applications of ineligible participants or applications not complying with these Terms and Conditions (“Ineligible Applications”) will be disqualified at full discretion of EKWB and no Promotion advantage will be awarded to such applicants.

The Promotional Offer cannot be combined with any other promotional offer valid at the time of order placement. For avoidance of doubt, the Promotional Offer does not apply to products subject to Clearance discounts.

EKWB shall not be liable in case the participation in the Promotional Offer is not possible due to temporary unavailability of the website or for other technical reasons outside of EKWB’s control.

 

5. Promotional Offers

With any order placed during Promotion Duration exceeding 250,00 EUR/USD/AUD (depending on the currency displayed in the webshop based on customer’s location), the customer can select a Promotional Gift of the customer’s choice free of charge.

The offer is valid while supply lasts. The stock of EK-CryoFuel gifts is limited.

 

6. Conditions of the Promotion

The Promotion and the Promotional Offer are subject to these Terms and Conditions. These Terms and Conditions supplement and precede the Terms of Sale, available at our website www.ekwb.com. In case of conflicts between these Terms and Conditions and the Terms of Sale, these Terms and Conditions shall prevail.

Participation in the Promotion is subject to acceptance of these Terms and Conditions and the Terms of Sale. By placing an order subject to Promotional Offer and selecting the free Promotional Gift, the consumer indicates his/her agreement to be bound by these Terms and Conditions and the Terms of Sale.

EKWB reserves the right to change, amend, or withdraw these Terms and Conditions at any time. EKWB reserves the right to change, amend or cancel the Promotional Offer at any time.

The fulfilment of any order placed under the Promotional Offer conditions, or fulfilment of the Promotion promise, is subject to availability of the chosen Promotional Gifts. EKWB does not guarantee availability of any products subject to Promotional Offer nor Promotional Gifts to individual consumers. EKWB reserves the right to cancel any order already placed in case of unavailability of the chosen Promotional Gifts or in case of Force Majeure.

EKWB shall not be liable for accuracy or completeness of the description of any Promotional Gift. The Promotional Gifts are as stated, the terms of the Promotion do not apply to any other products.

EKWB reserves the right to limit the availability of the Promotional Offer before the lapse of the Promotion Duration, or change or modify the list of Promotional Gifts during the Promotion Duration, or change the Promotion Duration in case of unavailability of Promotional gifts or Force Majeure.

“Force Majeure” for the purpose of these Terms and Conditions shall mean any unforeseeable event occurring after the public announcement of this Promotion that could not be expected, prevented or avoided and causes a delay in performance or the inability of EKWB to fulfil it. Examples of Force Majeure shall include e. g. natural disasters and catastrophes such as epidemics, nuclear accidents, fire, floods, hurricanes, earthquakes; actions or omissions of civil or military authorities, declaration of state of emergency, war or mobilisation, civil war or uprising, riots, sabotages or revolutions, etc. Any changes to the Promotion will be notified to participants as soon as possible.

In case of placement of an order subject to Promotional Offer and unavailability of the complementary Promotional benefit, EKWB will notify the customer thereof and leave up to his discretion to withdraw from the purchase, receive the purchased items without the Promotional benefit or receive the purchased items with a substitute promotional gift EKWB may offer. EKWB shall be free to provide substitute promotional gifts or not. EKWB does not grant and shall not be liable to provide substitute promotional gifts.

The benefits of the Promotion cannot be converted to any other benefits, used with any other purchases, redeemed in cash or other alternatives. The benefits of the Promotion are not transferrable or assignable to other consumers. The benefits of the Promotion may not be resold.

EKWB shall not be liable for inaccurate Promotional Offer details supplied to any participant by any third party connected with this Promotion.

EKWB assumes no responsibility or liability for any undesirable consequences that participants and/or anyone else could experience as a consequence of participation in this Promotion.

 

7. Withdrawal and returns

In the event that the consumer wishes to exercise his/her right to withdraw from the contract (”cooling-off”) or exercises 30-Day Money Back Guarantee offered by EKWB, the conditions of the Terms of Sale apply. All refunds will match the discounted amount on the purchase receipt.

 

8. Warranty

Warranty conditions of the EKWB’s Terms of Sale apply, available at our website www.ekwb.com.

 

9. Applicable Law and Jurisdiction

The Promotion and these Terms and Conditions shall be governed by the law of the Republic of Slovenia, without regard to the conflict of laws provisions. Any disputes will be subject to the exclusive jurisdiction of the competent court in Ljubljana, Slovenia.
