1. Organizer

 

The organizer of the Quantum Flash Sale 2024 (“Promotion”) is EKWB, d. o. o., whose registered business address is at Pod lipami 18, 1218 Komenda, Slovenia, registration No. 3358151000 (“EKWB”).

 

2. Purpose of the Promotion

 

The purpose of the Promotion is the promotion of EKWB and its products through promotional offer by providing purchase discounts ranging from 5 % up to 10 % (“Promotional Offer”) for orders of selected items pertaining to Quantum line of products (“Eligible Items”).

 

3. Promotion Duration

 

The Promotion is available and valid only during the period starting with 21 June 2024 at 18:00:00 (CEST) and ending on 23 June 2024 at 23:59:59 (CEST) (“Promotion Duration”).

 

Purchases of Eligible Items after the end of the Promotion Duration will not be eligible for Promotional Offer.

 

Promotional Offer is only available while the stock of Eligible Items lasts within the period of Promotion Duration.

 

4. Participation in the Promotion

 

The Promotion is only available to end-customers deemed as consumers (natural persons) (“Customers”) in case of purchase in EKWB’s webshop available at https://www.ekwb.com/shop/quantum-flash-sale. Individual Customers must be aged 16 years or more at the date of entry into the Promotion.

 

The Promotion is available worldwide.

 

For participation in the Promotion the Customer must place a binding order for one or more Eligible Items via EKWB’s webshop during the Promotion Duration.

 

The Promotional Offer will be automatically applied at the checkout in EKWB’s webshop to all Eligible Items in the orders during the Promotion Duration.

 

The Customer is not eligible for Promotional Offer and EKWB is not bound to provide Promotional Offer purchase conditions in the following cases:

• For the purchase of ineligible items.
• The purchase is made outside of Promotional Duration.
• The purchase is not made via EKWB’s webshop.

 

Promotional Offer cannot be applied to orders of Eligible Items that have already been finalized in the EKWB’s webshop by the Customer or for any previous purchases of Eligible Item, nor can it be used in conjunction with any other offer or discount.

 

When placing an order which includes also items ineligible for Promotional Offer, the discount will apply exclusively to Eligible Items.

 

The number of Eligible Items that may be ordered during the Promotion Duration is not limited. However, the Promotional Offer applies only to orders of household quantities, irrespective whether the order is made as a single order or as a combination of two or more orders. Orders exceeding household quantities will be disqualified at full and sole discretion of EKWB and no Promotion advantage will be awarded.

 

Purchases of ineligible customers or purchases not complying with these Terms and Conditions (“Ineligible Purchases”) will be disqualified at full discretion of EKWB and no Promotion advantage will be awarded to such applicants.

 

The Promotional Offer cannot be combined with any other promotional offer or used for preorder items..

 

EKWB shall not be liable in case the participation in the Promotional Offer is not possible due to temporary unavailability of the website or for other technical reasons outside of EKWB’s control.

 

5. Promotional Offers

 

The contents of the Promotional Offer entails discounts on the purchase of various Eligible Items ranging from 5 % to 10 %. The Eligible Items subject to Promotional Offer are marked in EKWB’s webshop. The discount is applied on the net purchase price (i. e. the price without VAT or other sales tax) of the individual Eligible Items. The actual discount rate for the particular Eligible Item is marked next to the Eligible Item’s purchase price (including the current discounted price and the prior applicable price).

 

6. Conditions of the Promotion

 

The Promotion and the Promotional Offer are subject to these Terms and Conditions. These Terms and Conditions supplement and precede the Terms of Sale, available at our website www.ekwb.com. In case of conflicts between these Terms and Conditions and the Terms of Sale, these Terms and Conditions shall prevail.

 

Participation in the Promotion is subject to acceptance of these Terms and Conditions and the Terms of Sale. By placing an order for products subject to the Promotion and Promotional Offer, the Customer indicates his/her /their agreement to be bound by these Terms and Conditions and the Terms of Sale.

 

EKWB reserves the right to change, amend, or withdraw these Terms and Conditions at any time. EKWB reserves the right to change, amend or cancel the Promotional Offer at any time.

 

The fulfilment of any order placed under the Promotional Offer conditions, or fulfilment of the Promotion promise, is subject to availability of the ordered product(s). EKWB does not guarantee availability of any products subject to Promotional Offer to the Customers. EKWB reserves the right to cancel any order already placed in case of unavailability of the chosen products or in case of Force Majeure. In case of placement of an order for any Eligible Item that is unavailable, EKWB will reject the order and notify the Customer thereof.

 

EKWB shall not be liable for accuracy or completeness of the description of any product subject to the Promotional Offer. The Promotional Offer products are as stated.

 

EKWB reserves the right to limit the availability of Eligible Items before the lapse of the Promotion Duration, or change or modify the list of Eligible Items during the Promotion Duration, or change the Promotion Duration in case of unavailability of products subject to Promotion, particularly in case of Force Majeure.

 

“Force Majeure” for the purpose of these Terms and Conditions shall mean any unforeseeable event occurring after the public announcement of this Promotion that could not be expected, prevented or avoided and causes a delay in performance or the inability of EKWB to fulfil it. Examples of Force Majeure shall include e. g. natural disasters and catastrophes such as epidemics, nuclear accidents, fire, floods, hurricanes, earthquakes; actions or omissions of civil or military authorities, declaration of state of emergency, war or mobilisation, civil war or uprising, riots, sabotages or revolutions, etc. Any changes to the Promotion will be notified to the Customers as soon as possible.

 

The benefits of the Promotion cannot be converted to any other benefits, used with any other purchases, redeemed in cash or other alternatives. The benefits of the Promotion are not transferrable or assignable to other consumers. The benefits of the Promotion may not be resold.

 

EKWB shall not be liable for inaccurate Promotional Offer details supplied to any participant by any third party connected with this Promotion.

 

EKWB assumes no responsibility or liability for any undesirable consequences that participants and/or anyone else could experience as a consequence of participation in this Promotion.

 

7. Withdrawal and returns

 

In the event that the consumer wishes to exercise his/her/their right to withdraw from the contract (”cooling-off”) or exercises 30-Day Money Back Guarantee offered by EKWB, the conditions of the Terms of Sale apply. All refunds will match the discounted amount on the purchase receipt.

 

8. Warranty

 

Warranty conditions of the EKWB’s Terms of Sale apply, available at our website www.ekwb.com.

 

9. Applicable Law and Jurisdiction

 

The Promotion and these Terms and Conditions shall be, insofar permitted by mandatory law, governed by the law of the Republic of Slovenia, without regard to the conflict of laws provisions . Any disputes will be, insofar permitted by mandatory law, subject to the exclusive jurisdiction of the competent court in Ljubljana, Slovenia.
