1. Organizer

The organizer of the EK B2C Customer Survey 2022 promotion (hereinafter “Giveaway”) is EKWB, d. o. o., whose registered business address is at Pod lipami 18, 1218 Komenda, Slovenia (“EKWB”).

2. Purpose of the Giveaway

The purpose of the Giveaway is the promotion of EKWB and its products by awarding the winners a benefit in the form of a gift card for purchase in EKWB’s and FluidGaming’s webshop (“Prize”).

3. Giveaway Duration

The participation in the Giveaway is possible only during the period starting on November 16, 2022 at 15:00 Central European Summer Time and ending on December 4, 2022 at 23:59 Central European Summer Time (»Giveaway Duration«).

Entries before or after Giveaway Duration will not be eligible for the Giveaway Prize.

4. Participation in the Giveaway

The Giveaway is only available to individual customers (natural persons) aged 18 years or more at the date of entry. The Giveaway is available worldwide, except where prohibited by law.

Notwithstanding the foregoing, the Giveaway is not available to employees and associates of EKWB or its affiliated companies, their immediate family members or members of the same household, or anyone otherwise connected or affiliated to EKWB.

The participation in the Giveaway is subject to Acceptance of these Terms and Conditions and the Privacy Policy. By submitting his/her application and participating in this Giveaway, the participant is indicating his/her agreement to be bound by these Terms and Conditions and the Privacy Policy.

To participate in the Giveaway, the participant must submit a fully filled-in customer survey questionnaire and all required information via the form available at https://ekwbadmin.typeform.com/to/zMDNoB4K for EK Water Blocks customers or https://ekwbadmin.typeform.com/to/c6bhVogx for EK Fluid Gaming customers during the Giveaway Duration, including the indicated personal data collected in accordance with EKWB’s Privacy Policy, available at www.ekwb.com. By submitting the application, the participant grants EKWB the permission to use the submitted information for the purpose of advertising, direct marketing and conducting market surveys, without the right to compensation.

Applications containing incomplete survey questionnaire or missing required data, applications of ineligible participants or applications not complying with these Terms and Conditions (“Ineligible Applications”) will be disqualified at full discretion of EKWB and no Giveaway Prize will be awarded to such applicants.

No purchase is necessary to enter or win the Sweepstakes. A purchase does not increase the chances of winning.

Only one Giveaway application is permitted per person. Multiple applications from the same person will be disqualified. EKWB shall not be liable in case of temporary unavailability of the Giveaway application website or failure to receive an application. No participant can win more than one Giveaway Prize. The prize is not transferrable or assignable to other persons. 

5. Giveaway Prize

The Giveaway Prize will be awarded to any eligible participant submitting a fully filled-in customer survey questionnaire and all required information.

The Giveaway Prize consists of a digital gift card for the purchase in EKWB shop at https://www.ekwb.com/shop/ and Fluid Gaming shop at https://www.ekfluidgaming.com/ in the amount of 100,00 USD, valid until 31 January 2023. Only one gift card per participant and per purchase can be used. In total EKWB will giveaway ten gift cards.

The Giveaway Prize is as stated. The Giveaway Prize cannot be converted to any other benefits, exchanged for products, redeemed in cash or other alternatives, unless EKWB decides otherwise at his sole and full discretion. The specifications of the Giveaway Prize shall be within the full and sole discretion of EKWB.

EKWB shall not be liable for inaccurate Giveaway Prize details supplied to any participant by any third party connected with this Giveaway.

EKWB assumes no responsibility or liability for any undesirable consequences that participants and/or anyone else could experience as a consequence of participation in this Giveaway.

6. Winners Selection, Notification, Delivery

The winners will be selected by an automated random draw under the supervision of EKWB from among the received eligible applications. The odds of winning depend on the number of eligible entries received. 

The winners will be selected within three days from the end of the Giveaway Duration and notified via electronic mail within further three days after the selection. The participants must ensure at their own cost and responsibility the possibility of delivery of the notice on winning the Giveaway Prize. EKWB shall not be liable for winner’s inability to receive the notice due to submission of incorrect contact data or security settings in the information system preventing the delivery of the notice.

The winners must claim the Giveaway Prize within seven days after reception of the notice and at request of EKWB provide completed and executed declaration and release statement.

The winners will be delivered the Giveaway Prize via electronic mail within three days after the submission of the completed application. The participants must ensure at their own cost and responsibility the possibility of delivery of the notice and the Giveaway Prize. EKWB shall not be liable for participant’s inability to receive the notice and Giveaway Prize due to submission of incorrect contact data or security settings in the information system preventing the delivery of the notice.

The Giveaway Prizes will be delivered to the winners to the email address submitted at the time of Giveaway entry. All mandatory federal, state, and/or local taxes, duties, fees and charges associated with the reception of the Giveaway Prize in the country of the winner’s residence, shall be borne by the winner.

If the participant is not eligible for participation in the Giveaway (Ineligible Applications), cannot be contacted, fails to claim the Giveaway Prize within the set period, fails to timely provide the completed and executed declaration and release statement or if the delivery of the Giveaway Prize is not possible due to reasons attributable to the participant (e. g. submission of wrong address), EKWB reserves the right to forfeiture of the Giveaway Prize with regard to the winner and selection of an alternate winner according to the procedure set forth above.

The winners shall ensure that the acceptance of the Giveaway Prize does not constitute a breach of mandatory law. In such case, EKWB reserves the right, at his sole and full discretion, to disqualify the winner and all privileges of the participant will be immediately terminated.

EKWB reserves the right not to award the Giveaway Prize if there is doubt about the identity of the winner, the accuracy of the data submitted by the winner or compliance with these Terms and Conditions.

EKWB reserves the right not to award the Giveaway Prize, to cancel or amend the Giveaway without notice in the event of a Force Majeure event. “Force Majeure” shall mean any unforeseeable event occurring after the public announcement of this Giveaway that could not be expected, prevented or avoided and causes a delay in performance or the inability of EKWB to fulfil it. Examples of Force Majeure shall include e. g. natural disasters and catastrophes such as epidemics, nuclear accidents, fire, floods, hurricanes, earthquakes; actions or omissions of civil or military authorities, declaration of the state of emergency, war or mobilisation, civil war or uprising, riots, sabotages or revolutions, etc. Any changes to the Giveaway will be notified to participants as soon as possible.

EKWB’s decisions on winners as well as other matters pertaining to the Giveaway are final and binding. No challenges, complaints or other legal remedies shall be available.

7. Conditions of the Giveaway

The Giveaway and the Giveaway Prize are subject to these Terms and Conditions. These Terms and Conditions of the EK B2C Customer Survey 2022 promotion (“Terms and Conditions”) supplement EKWB’s Privacy Policy, available at EKWB’s website www.ekwb.com. In case of conflicts between these Terms and Conditions and the Privacy Policy, these Terms and Conditions shall prevail.

EKWB reserves the right to change, amend, or withdraw these Terms and Conditions at any time. EKWB reserves the right to change, amend or cancel the Giveaway Prize at any time.

8. Applicable Law and Jurisdiction

The Giveaway and these Terms and Conditions shall be governed by the law of the Republic of Slovenia, without regard to the conflict of laws provisions. Any disputes will be subject to the exclusive jurisdiction of the competent court in Ljubljana, Slovenia.
